§ 33.032 INTERNATIONAL FIRE CODE ADOPTED; MODIFICATIONS.
   (A)   (1)   The International Fire Code, including appendixes printed as a code in book form by the International Code Council and other referenced NFPA standards adopted by the state under the state’s Fire Code Adoption Act, being U.C.A. Title 15A, Chapter 1, Part 4 (establishing rules and regulations for the design, construction, quality of materials, use, location and maintenance of building fire provisions), or its successor statute, and as it may be subsequently amended or revised, one copy of which, including changes, have been filed for use and examination by the public in the office of the City Recorder, is hereby approved and adopted as the International Fire Code of the city.
      (2)   Any amendments, modifications, supplements or later editions of said code replacing said code shall constitute the code then in effect under this subchapter; provided, however, that, before any later editions shall take effect, the City Council, by resolution, shall certify that the later editions are available and one copy of all amendments, modifications, supplements or later editions shall be filed for examination and use by the public in the office of the City Recorder.

   (B)   The Fire Marshal, with the approval of the City Council, shall have the power to modify any of the provisions of the International Fire Code upon application in writing by the aggrieved owner or lessee or his or her duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the code; provided that, the spirit of the code shall be observed, public safety secured and substantial justice done. The particulars of such modification when granted or allowed and the decision of the Fire Chief and Council thereon shall be recorded in the Building Official’s records and a signed copy shall be furnished to the applicant.
