For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
CALLS FOR SERVICE. Calls for the city’s Police Department or other law enforcement agencies concerning a transient lodging facility in connection with law enforcement services related to criminal activity, civil disputes or violations of local, state or federal laws, which result in law enforcement personnel being dispatched or directed to the transient lodging facility. CALLS FOR SERVICE include incidents observed by police that a violation of the law has occurred or is occurring at the transient lodging facility. Multiple calls for one discrete event shall count as one CALL FOR SERVICE. CALLS FOR SERVICE shall not include the following: calls initiated by the owner, manager or employee of a transient lodging facility; medical calls unrelated to criminal activity; calls originating from the transient lodging facility but relating to off-premises disturbances; calls related to the enforcement of an existing protective order or stalking injunction.
OWNER. Any person with an ownership interest in or who is directing the operation of a transient lodging facility.
POLICE. Any authorized agent or officer of the city’s Police Department or any other officer or agent of a local, state or federal law enforcement agency having jurisdiction.
TRANSIENT LODGING FACILITY. Any building or property, its associated parking, landscaping and other ancillary facilities with more than ten rental units, that provides lodging accommodations on a daily or other basis or used or maintained as or advertised or held out to the public to be an inn, motel, hotel or any other place where sleeping, rooming, conference or exhibition accommodations are furnished for lease or rent, whether with or without meals. One room offered for rental with or without an adjoining bath shall be considered as a single hotel or motel unit. In no event shall these terms be construed to mean rooming houses, dormitories, apartment houses or other types of permanent residential uses.
