§ 94.999 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.999 of this code of ordinances.
   (B)   Any person or entity deemed to be in violation of the provisions of §§ 94.001 through 94.008 of this chapter for a first offense may be charged with a criminal infraction. Any individual or entity who have subsequent and repeat violations of §§ 94.001 through 94.008 of this chapter may be charged with criminal charges up to a Class B misdemeanor. In addition to the violation set forth herein, a violation under this code may be deemed a public nuisance and the city may institute any civil action necessary to abate a public nuisance under §§ 94.001 through 94.008 of this chapter.

   (C)   Any violation of § 94.020 of this chapter shall be punishable as a violation of Chapter 33 of this code of ordinances and fire suppression costs may be recovered as outlined in Chapter 33 of this code of ordinances.
