§ 94.005 PERMISSIBLE BURNING; PERMIT REQUIRED.
   Except as prohibited by local, state or federal laws, the following types of burning are permitted; provided that, an open burn permit has first been approved and obtained:
   (A)   The burning of trimmings from trees, bushes, plants, yards or of dead and diseased trees; including stubble, incidental to horticulture;
   (B)   Open burning of materials or structures when conducted under the direct control and supervision of the city’s Fire Chief or his, her or their designee;
   (C)   Fires for the training of firefighters when conducted under the control and supervision of the city’s Fire Chief or his, her or their designee;
   (D)   Open burning at an approved site of hazardous materials for which there is no practical or reasonable alternative method of disposal; provided that, such burning shall be under the supervision of the City Fire Chief or his, her or their designee, and in accordance with state law; and
   (E)   Other open burning for special purposes or under unique circumstances when approved by the city’s Fire Chief and the county’s Health Department following a formal request.
