For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
OPEN BURNING. To do any of the following:
(1) AGRICULTURAL BURNING.
(a) Burning incident to horticultural or agricultural operations of which the following materials are burned:
1. Pruning’s from trees, bushes and plants; or
2. Dead or diseased trees, bushes and plants, including stubble.
(b) Burning of weed growth along ditch banks incident to clearing these ditches for irrigation purposes.
(c) Controlled heating of orchards or other crops to lessen the chances of these being frozen so long as the emissions from this heating do not violate minimum standards as set forth by the state’s Department of Environmental Quality.
(2) OPEN BURNING. Burning which involves residents or property owners burning tree trimmings or yard trimmings.
RECREATIONAL FIRE. An outdoor fire that is burning materials other than rubbish where the fuel being burned is not contained in an incinerator, outdoor fireplace, portable outdoor fireplace, barbeque grill or barbeque pit, and has a total fuel area of three feet or less in diameter and two feet or less in height for pleasure, religious, ceremonial, cooking, warmth or similar purpose.
PORTABLE OUTDOOR FIREPLACE.
(1) A portable outdoor, solid-fuel-burning fireplace that may be constructed of steel, concrete, clay or other non-combustible material.
(2) A PORTABLE OUTDOOR FIREPLACE may be open in design, or may be equipped with a small hearth opening and a short chimney or chimney opening in the top.
