(A) The following regulations shall apply to all licensed commercial haulers.
(B) Violation of any of the following shall be a Class B misdemeanor and shall constitute a sufficient basis to suspend or revoke a hauler’s license.
(1) Commercial haulers shall not engage in residential collection.
(2) (a) All vehicles used to collect or carry refuse must be in good mechanical condition and all mechanisms relevant to the hauling of refuse must be fully operable.
(b) Each vehicle, except roll-off vehicles, manufactured after 1-1-1990, shall be equipped with a backup alarm and one or more amber warning lights.
(c) The warning light(s) shall be mounted near the rear of the vehicle in an area visible to the public.
(d) Roll-off vehicles shall be equipped with a backup alarm.
(3) All vehicles used to collect or transport, except for roll-off service containers, shall be fully enclosed with water-tight sides and bottom.
(4) The tailgate of each vehicle used to collect or carry refuse shall be so constructed as to prevent the contents of the body spilling or blowing from the vehicle while in motion.
(5) The outside of the body of each vehicle used by a commercial hauler to collect or carry refuse must be clearly painted and identified with the name and telephone number of the licensee.
(6) All vehicles used to collect or carry refuse shall comply with all applicable state and federal statutes and regulations relating to such vehicles.
(7) Haulers shall comply with all provisions of this chapter and all applicable state or federal regulations or laws concerning the collection, transportation or disposal of refuse.
