(A) (1) The Public Works Department shall have control over all use of all public parks, playgrounds and recreational facilities for sporting and special events.
(2) Accordingly, all public parks, playgrounds and recreational facilities shall be reserved for use according to the policies of the city and based on availability and priority.
(3) The Public Works and Community Activities and Services Departments reserve the right to cancel any scheduled activity due to conditions or circumstances that are determined to be unsafe or in conflict with city ordinances or policies.
(B) (1) No automatic or protected right based upon previous use, to use any public park, playground or recreational facilities, shall be granted.
(2) The city reserves the right to deny use of any public park, playground or recreational facilities to any user that, in the city’s opinion, has had public relations or financial problems, has previously misused or abused facilities or property, has administered its programs or events in such a way to cause discredit to the city, or has not paid all fees due or past due.
(C) Reservation and use of any public parks, playgrounds and recreational facilities for sporting and special events shall also be governed or regulated by policy.
