§ 91.081 LIBRARY BOARD OF TRUSTEES; POWERS AND DUTIES.
   (A)   There is hereby created and established a Library Board of Trustees of the Brigham City Public Library in accordance with U.C.A. § 9-7-4.

      (1)   Compliance. The Library Board shall follow the state’s Open and Public Meetings Act. The members of the Library Board are appointed officials of the city and shall comply with the terms of the state’s Municipal Officers and Employees Ethics Act, U.C.A. §§ 10-3-1301 through 10-3-1312, as currently enacted or as it may be amended.

      (2)   Appointments.
         (a)   The Library Board shall consist of the following voting members:
            1.   Six Trustees, appointed by the Mayor of the city and approved by the City Council, who are residents of the city, based on their fitness for the office; and
            2.   One member of the City Council. Only one member of the city governing body may be, at any one time, a member of the Library Board.
         (b)   Appointments shall be made annually prior to July 1.

      (3)   By-laws. The Library Board shall establish by-laws not inconsistent with the law.

      (4)   Compensation and expenses. Each trustee shall serve without compensation, but their actual and necessary expenses incurred in the performance of their official duties may be paid from library funds in accordance with U.C.A. § 9-7-402.

      (5)   Terms; organization; removal from office; vacancies.
         (a)   Each Trustee shall be appointed for a three-year term, or until the successor to that trustee is appointed. Initially, appointments shall be made for one-, two- and three-year terms. Annually thereafter, the city governing body shall, before July 1 of each year, appoint for a three-year term Trustees to take the place of the retiring trustees.
         (b)   Trustees shall serve not more than two consecutive full terms.
         (c)   The Trustees shall annually select a Chairperson and other officers.
         (d)   The city governing body may remove any Trustee for misconduct or neglect of duty.
         (e)   Vacancies in the Library Board shall be filled for the unexpired term in the same manner as original appointments.

      (6)   Legal counsel. The city shall furnish legal counsel to the Board to provide members with general legal advice concerning matters before them for consideration. Board members shall be represented by legal counsel at the library’s expense in all matters arising from service within the scope of their duties in accordance with Utah Code.

   (B)   (1)   Basic duties. In adherence to U.C.A. § 9-7-404, the Library Board shall:
         (a)   Maintain and care for the library by making recommendations for the upkeep of its facilities and by participating in the financial planning to find funds for associated costs;
         (b)   Establish policies for its operation; and
         (c)   In general, carry out the spirit and intent of the provisions set forth in the Utah Code Annotated.

      (2)   Rules for the use of the library. In accordance with U.C.A. § 9-7-405, the Library Board shall make, amend and repeal rules, not inconsistent with law, for the governing of the library, as the Library Board deems appropriate for public library service in the city. These include all rules and policies governing the use of the library’s services to the public, including, but not limited to, all fines and fees related to library programs and services as set by resolution by the Library Board.

      (3)   Reports to City Council and the Director of the state’s Library Division.
         (a)   The Library Board shall provide an annual report to the Mayor and City Council on the condition and operation of the library.
         (b)   The Library Board shall provide an annual report that contains information required by the state’s Library Board.

      (4)   Appointment of Library Director.
         (a)   The Library Director shall be appointed by the Library Board with advice of the Mayor or their designee(s) to run the day-to-day operations of the Brigham City Library.
         (b)   Upon appointment and confirmation, the Library Director shall:
            1.   Be an employee of the city:
               a.   The Library Director shall be an exempt employee of the city;
               b.   The Library Director shall be assigned compensation and benefits in accordance with Brigham City Employee Policy and Procedures, and applicable wage studies, during the hiring process;
               c.   The Library Director shall be accountable to the City Administrator or designee for the performance of the Brigham City Library and its employees; and
               d.   The Library Director shall be subject to discipline up to and including termination in accordance with Brigham City Employee Policy and Procedures.
            2.   Have the following duties:
               a.   The Library Director shall manage the day-to-day operations of the library; and
               b.   The Library Director shall act as the executive officer of the Library Board.

      (5)   Appointment of other personnel. The Library Board shall appoint, upon the recommendation of the Library Director, other personnel as needed. Personnel shall be selected in accordance with the city’s hiring process at the recommendation of the Library Director and with the approval of the Mayor and the City Administrator. New hires will be announced at the next Library Board meeting, for ratification.
         (a)   All library personnel, appointed or otherwise, qualify for compensation, benefits and the like, as the city provides to all city employees in accordance with the library’s budget and the Brigham City Employee Policy Manual.
         (b)   Library personnel are subject to the employee and administrative policies of the city and the policies of the library.

      (6)   Advising the City Council. The Library Board shall make recommendations to and advise the City Council on matters before the Council which affect the library.
