§ 91.006 RULES OF USE.
   (A)   Brigham Academy Center.
      (1)   No smoking allowed. No smoking, including e-cigarettes, is allowed upon the premises pursuant to state law and local ordinances. It shall be the sole responsibility of the user to enforce this rule. In the event this rule is violated, the city will withhold all deposits as a penalty for the failure of the user to enforce this condition.
      (2)   Alcohol use and consumption. No alcohol may be sold on the premises or distributed to the public. Private parties, not open to the public, may be allowed to bring alcohol onto the premises provided the alcohol dispensed is to invited adult guests only, the alcohol dispensing and consumption occurs only indoors, without cost, and in accordance with state law, city’s ordinances and terms and conditions regarding any alcohol dispensing, use and consumption by members of the private party.
      (3)   Lewd conduct on premises. The lessor and all permitted users shall not allow any conduct by any individual on the premises that is prohibited by state law, include any lewd behavior prohibited by state law or the city’s ordinances or showing of any visual reproduction showing the same.
      (4)   Property damage. Any damage to the facility or any of its contents arising out of the user’s use of the facility shall be the sole responsibility of the user. In the event of such damage, the lessor, with permission from the city, shall make a determination as to the cost of repairs or replacement, and the user shall immediately pay said determined cost to the lessor and/or the city.
      (5)   City use. The city and county shall have use of the facility one time per year at no cost to the city or county
   (B)   City Hall.
      (1)   Reservations.
         (a)   Reservations for the use of the facility shall be made by contacting the Mayor’s executive assistant.
         (b)   A form shall be completed by the applicant identifying, among other things, the applicant, the dates and times of use, the nature and type of function(s) and an agreement to abide by all of the rules governing the use of the facility.
         (c)   The city reserves the right to cancel any reservation due to emergency scheduling of city functions.
      (2)   User fees. There are no user fees associated with governmental use of City Hall.
      (3)   Setting up. No articles are to be pinned onto the walls as decorations or signs. Large items must be pre-approved and may only be brought in during the scheduled activity. The city is not responsible for any damage to said items.
      (4)   Use only of area reserved. The user shall be allowed to use the Council Chambers and restrooms. Access to all other areas is prohibited.
      (5)   No smoking or alcoholic beverages allowed. No smoking, including e-cigarettes or alcoholic beverages shall be allowed upon the premises pursuant to state law and local ordinances. It shall be the sole responsibility of the user to enforce this rule. In the event this rule is violated, the city will withhold all deposits as a penalty for the failure of the user to enforce this condition.
      (6)   Lost items. Any lost or misplaced items found will be held for one month, after which time these items will be discarded.
      (7)   Time. The facility will only be available during regular business hours, Monday through Friday, 8:00 a.m. to 5:00 p.m. unless specific circumstances exist to allow after-hours use. Any after-hours use must be approved by the Mayor.
      (8)   Users. Only governmental agencies may be allowed to use the facility. No use of city-owned audio/visual equipment is allowed. Social events such as dances, receptions, parties and private user groups are prohibited with the exception of marriage ceremonies conducted by the Mayor.
      (9)   Property damage. Any damage to the facility or any of its contents arising out of the user’s use of the facility shall be the sole responsibility of the user. In the event of such damage, the city shall make a determination as to the cost of repairs or replacement, and the user shall immediately pay said determined cost to the city.
   (C)   Community Center.
      (1)   Reservations. Reservations for the use of the Community Center shall be made through the city. Reservation time includes setup and cleanup time. Booking of reservations may only be made up to 12 months in advance.
      (2)   User fees. All fees for the use of this facility shall be paid prior to use pursuant to the attached fee schedule.
      (3)   Cleaning costs. Any and all costs related to the user’s use of the facility which exceed the normal cleaning costs associated with the city’s use of the facility, shall be paid by the user to the city pursuant to the fee schedule in § 91.007 of this chapter.
      (4)   Setting up.
         (a)   No articles are to be taped on the walls as decorations or signs. Large items such as props, must be approved by the facility supervisor and may only be brought in during the scheduled activity.
         (b)   The city is not responsible for any damage to said items. If user requires the use of tables and chairs, an additional set up fee may be charged. User is responsible to set up tables and chairs and to put them away at the conclusion of use.
      (5)   Use only area reserved. The user shall only be entitled to use those portions of the building actually reserved and paid for by the user. The kitchen is not available for public use. Access to all other areas is prohibited. Telephones located in the building are not for public use.
      (6)   No smoking or alcoholic beverages allowed. No smoking, including e-cigarettes, or any alcoholic beverages are allowed upon the premises pursuant to state law and local ordinances.
         (a)   It shall be the sole responsibility of the user to enforce this rule.
         (b)   In the event this rule is violated, the city will withhold all deposits as a penalty for the failure of the user to enforce this condition.
      (7)   Lost items. Any lost or misplaced items found will be held for one month, after which time these items will be discarded.
      (8)   Catering. If the user contracts a caterer, the caterer must have a current Health Department permit.
      (9)   Time. The doors will be opened for the scheduled activity only at the time previously scheduled. Use of the facility shall be allowed only during the reserved hours. All reservations must conclude by 10:00 p.m. Thirty minutes thereafter will be allowed for vacating the parking lot. The facility is not available on Sundays or on legal holidays.
      (10)   Property damage. Any damage to the facility or any of its contents arising out of the user’s use of the facility shall be the sole responsibility of the user. In the event of such damage, the city shall make a determination as to the cost of repairs or replacement, and the user shall immediately pay said determined cost to the city.
      (11)   Dances and/or bands. No dances and/or bands are allowed, except dances sponsored by the Community Center as part of their approved programming.
   (D)   Fire Station.
      (1)   Reservations. Reservations from governmental agencies for the use of the facility shall be made by contacting the Fire Chief or designee.
      (2)   User fees. All fees for the use of this facility are as specified on the attached fee schedule.
      (3)   Setting up. User is responsible to set up tables and chairs and to put them away at the conclusion of use. No articles are to be pinned onto the walls as decorations or signs. Large items must be approved by the Fire Chief and may only be brought in during the scheduled activity. The city is not responsible for any damage to said items.
      (4)   Use only of area reserved. The user shall be allowed to use the main meeting/training room and associated restrooms. Access to all other areas is prohibited.
      (5)   No smoking or alcoholic beverages allowed. No smoking, including e-cigarettes, nor any alcoholic beverages are allowed upon the premises pursuant to state law and local ordinances. It shall be the sole responsibility of the user to enforce this rule.
      (6)   Lost items. Any lost or misplaced items found will be held for one month, after which time these items will be discarded.
      (7)   Time. The doors will be opened for the scheduled activity only at the time previously scheduled. Use of the facility shall be allowed only during the reserved hours. The facility is not available on Sundays, except emergency situations.
      (8)   Users. Only governmental agencies may be allowed to use the facility. Social events such as dances, receptions, weddings, parties and private user groups are prohibited.
      (9)   Property damage. Any damage to the facility or any of its contents arising out of the user’s use of the facility shall be the sole responsibility of the user. In the event of such damage, the city shall make a determination as to the cost of repairs or replacement, and the user shall immediately pay said determined cost to the city.
   (E)   Library.
      (1)   Reservations. Reservations for the use of the facility shall be made by contacting the library. The facility is available for rental Monday through Saturday, with the exception of legal holidays, as the scheduling calendar allows. Rooms may be scheduled up to 30 days in advance in accordance with the library’s meeting room policy.
      (2)   User fees. All fees for the use of this facility shall be pursuant to the attached fee schedule and according to the library’s meeting room policy.
      (3)   Cleaning costs. Any and all costs related to the user’s use of the facility which exceed the normal cleaning costs associated with the city’s use of the facility, shall be paid by the user to the city.
      (4)   Setting up. No articles are to be pinned or taped on the walls without prior approval. Large items may be brought in with prior approval. All items must be removed at the conclusion of the activity. The city is not responsible for the loss of or damage to said items.
      (5)   Use only area reserved. The user shall only be entitled to use those portions of the building actually reserved and paid for by the user. Access to all other areas is prohibited. There is no public telephone available.
      (6)   No smoking or alcoholic beverages allowed. No smoking, including e-cigarettes, or any alcoholic beverages shall be allowed upon the premises pursuant to state law and local ordinances. It shall be the responsibility of the applicant to enforce this rule. Additionally, no food or other beverages are allowed in the library’s meeting rooms with an exception for covered beverages. Refreshments may not be served without prior approval from the Library Director.
      (7)   Lost items. Any lost or misplaced items found will be held for one week, after which time these items will be discarded.
      (8)   Time. Staff will open the doors for the scheduled activity only at the time scheduled. Both set up and clean up time should be included in the request. Reservations shall end at 8:30 p.m., Monday through Thursday, and 5:30 p.m., Friday and Saturday.
      (9)   Property damage. Any damage to the facility or any of its contents arising out of the user’s use of the facility shall be the sole responsibility of the user. In the event of such damage, the city shall make a determination as to the cost of repairs or replacement, and the user shall immediately pay said determined cost to the city.
   (F)   Outdoor swimming pool.
      (1)   Reservations.
         (a)   Opening day for pool reservations will be advertised annually through the local paper, city email blasts and social media.
         (b)   The facility is available Monday through Saturday beginning the first Saturday after school is let out in the county until the week before school commences in the county.
      (2)   User fees. The fees for the use of this facility shall be pursuant to the fee schedule in § 91.007 of this chapter.
      (3)   Time. Times for pool reservations are listed on the fee schedule in § 91.007 of this chapter.
      (4)   Use only area reserved. Reservations include use of the pool and restroom areas. In order for the concession stand to be open during reservations, a request must be made one week prior to the date of the reservation.
      (5)   Food and beverages. No glass containers are allowed in the facility. Any outside food preparation equipment must be preapproved by the pool supervisor.
      (6)   No smoking or alcoholic beverages allowed.
         (a)   No smoking, including e-cigarettes, or alcoholic beverages shall be allowed upon the premises.
         (b)   It shall be the responsibility of the applicant to enforce this rule.
         (c)   In the event this rule is violated, the city will withhold all of the cleaning and property damage deposit as a penalty for the failure of the user to enforce this condition pursuant to resolution by the City Council.
      (7)   Lost items. Any lost or misplaced items found will be held for one week, after which time these items will be discarded.
      (8)   Property damage. Any damage to the facility or its contents arising out of the user’s use of the facility shall be the sole responsibility of the user. In the event of such damage, the city shall make a determination as to the cost of repairs or replacement, and the user shall immediately pay said determined cost to the city pursuant to resolution of the City Council.
   (G)   Park Boweries.
      (1)   Reservations. Opening day for park reservations will be advertised annually through the local paper, city email blasts and social media. The bowery facilities are available seven days a week beginning Memorial Day weekend through September 30. Bowery reservations must be made seven days ahead of the desired reservation date. No reservations will be accepted during the week of Peach Days.
      (2)   User fees. The fees are due at the time of reservation for the use of this facility shall be pursuant to the fee schedule in § 91.007 of this chapter.
      (3)   Time. The boweries are available from 9:00 a.m. until 10:00 p.m. daily.
      (4)   Use only area reserved. Reservations include the bowery only and do not include exclusive use of tennis courts, ball diamonds, volleyball court, playgrounds or other facilities.
      (5)   Bounce houses/inflatables. The use of bounce houses and/or inflatables in city parks is prohibited.
