§ 155.244 APPEALS OF CITY GEOLOGIC HAZARD STANDARDS AND REQUIREMENTS OR SUBDIVISION IMPROVEMENT PLANS.
   (A)   An applicant who has appealed a decision of a Land Use Authority administering or interpreting the city’s geologic hazard ordinance, standards or requirements or the requirements of final subdivision improvement plans may request the city assemble a panel of qualified experts to serve as the Appeal Authority for purposes of determining the technical aspects of the appeal.
   (B)   If an applicant makes a request under this section, the city shall assemble the panel described:
      (1)   One expert designated by the city;
      (2)   One expert designated by the applicant;
      (3)   One expert chosen jointly by the city’s designated expert and the applicant’s designated expert; and
      (4)   Each member of the panel assembled by the city under this division (B) shall not be associated with the application that is the subject of the appeal.
   (C)   The applicant shall pay:
      (1)   One-half of the cost of the panel; and
      (2)   The city’s published appeal fee.
