§ 155.099 NO-DEDICATION SUBDIVISION OF FIVE OR FEWER LOTS AND NO MORE THAN TEN DWELLING UNITS APPLICATION REVIEW PROCEDURES.

Combined Preliminary - Final Subdivision Plat Application Procedures for No-Dedication Subdivisions of Five or Fewer Lots and No More Than Ten Dwelling Units
Step 1
Applicant submits required application materials (§ 155.096) and pays application fees to the Department. Within 30 days, the Department must determine if the preliminary subdivision plat application is complete.

Department determines application complete.
An applicant has 30 days from time of the Departments written notice of decision to submit missing materials and fees. If the application remains incomplete, fees and materials submitted to the Department are returned to the applicant, and the application is no longer considered.
Step 3
No later than 20 business days after receiving a complete final subdivision plat application, DRT reviews application before Planning Commission meeting to ensure all requirements have been met and provides a written report to the applicant.
Step 4
The Director, or designee must consider the DRT recommendations and all other materials in its decision to approve, approve with revisions, or deny the application.
Step 5
The approval of a no-dedication subdivision of five or fewer lots and no more than ten dwelling units application, with or without requirements, by the Director shall constitute final approval of the subdivision by the city. The plat shall be signed by all parties required by § 155.101 and recorded in the Office of the Box Elder County Recorder within 365 days of Director approval.
