§ 155.075 FINAL SUBDIVISION PLAT APPLICATIONS.
   (A)   Recommendations and permits required.
      (1)   Before the Land Use Authority, as applicable, considers a final subdivision plat application, the Department staff, City Engineer, Public Works Director, Fire Chief, Public Power Director and City Attorney shall transmit a recommendation to the Land Use Authority, accompanying the final subdivision plat application, for the Land Use Authority’s consideration.
      (2)   If the subject property is located within the boundaries of a Special Service District or Special Service Area, a written recommendation from the governing board of such district or area shall accompany the final subdivision plat application for the Land Use Authority’s consideration.
      (3)   If the subdivision is required to secure any approvals or permits from any federal, state or local agency, a copy of such approvals and permits shall accompany the final subdivision plat application for consideration by the Land Use Authority, as applicable.

   (B)   Final subdivision plat application for nine or fewer lots and no-dedication subdivision of five or fewer lots; Department to consider and decide one final subdivision plat application only for original parcel.
      (1)   Consistent with § 155.053(A) of this chapter, the approval of a final subdivision plat application for nine or fewer lots, with or without requirements, and a no-dedication subdivision of five or fewer lots, with or without requirements, shall be utilized only once per original parcel of property. Property subdivided under these provisions shall be accompanied by a note on the parcel or lot number and on the final subdivision plat that clearly identifies that this one-time division has occurred and the resulting lots, including any portion of the original parcel of property, may not be further subdivided without the approval and recordation of a new final plat or an amended final plat with the effect of modifying the existing final plat, as provided by the Act.

      (2)   ORIGINAL PARCEL OF PROPERTY means the property existing and recorded in the office of the Box Elder County Recorder as determined by the property identification number existing on the date of the application submission.
   (C)   Engineering review fees. In addition to application fees, the applicant(s) for final subdivision plat application shall pay all costs incurred by the city for the provision of city engineering services, provided by a licensed civil engineer, contracted by the city and required to review the final subdivision plat application and all associated materials for conformity to the requirements of this chapter, other applicable land use ordinances and requirements, and accepted civil engineering practice.
