The following activities are exempt from the requirements of this subchapter:
(A) Actions by a public utility, the city or any other entity to remove or alleviate an emergency condition, restore utility service, reopen a public thoroughfare to traffic or otherwise protect public health and safety and welfare; and
(B) Bona fide agricultural and farming operations which constitute the principal use of any lot or tract of ground located within the city and which meet the requirements of the zoning code of the city. Bona fide agricultural activities are exempt from this requirement; however, such activities should be performed in such a manner as to prevent pollutants (including, but not limited to, sediment, fertilizers, and contaminated irrigation tailwater) from entering the storm water system. Construction activities and stockpiling of import material on agricultural or farming property are not exempt activities.
