(A) It is unlawful for any person to obstruct or contribute to the obstruction of the flow of storm water runoff or non-storm water runoff into any sump, detention or retention basin, storm drain, curb and gutter, drain inlet or other associated structural controls that convey storm water and/or non-storm water runoff.
(B) It is unlawful for any person to cause any obstruction that inhibits the normal flow of storm water and/or non-storm water runoff in any curb and gutter, subject to the exemptions below. The following obstructions are exempt from the prohibitions of this section:
(1) Street and/or storm water improvement projects authorized by the city;
(2) Flood-control and prevention activities performed by the city;
(3) Obstructions approved by the city as part of a site’s storm water control plan; and
(4) Obstructions occurring during clean-up periods established by the city; provided that, the materials are placed according to city directions and do not obstruct drain inlets.
(C) It is unlawful for a person to cover any drain inlet for any reason or purpose, except:
(1) For the purpose of filtering the storm water; or
(2) For emergency situations per authorized personnel, such as to prevent hazardous contaminants from entering the storm drain system.
