(A) Application fees. The Department shall charge an application fee for the review of an application, a consolidated application and an application for renewal of a small wireless facility permit. The purpose of these fees is to enable the Department to recover its costs related to reviewing the application provided these costs are not recovered by existing fees, rates, licenses or taxes paid by an applicant. An application fee shall not include travel expenses incurred by a third party in review of an application; or payment or reimbursement of a third-party rate or fee charged on a contingency basis or a result-based arrangement. These application fees shall be listed in the city’s fee schedule. The fee for a consolidated application shall be no less than the fee for an application multiplied by the number of small wireless facility permits requested in the consolidated application.
(1) An application fee for the collocation of a small wireless facility on an existing or replacement utility pole shall not exceed the lesser of the cost of granting a building permit for similar types of commercial development or construction within the city or $100.
(2) An application fee for the installation, modification or replacement of a utility pole or wireless support structure associated with a small wireless facility or wireless support structure, wherein the applicant is seeking to perform an activity consistent with this subchapter, shall not exceed $250.
(B) Right-of-way fees.
(1) The Department shall charge a right-of-way fee for the collocation of a small wireless facility on a utility pole in the right-of-way or for the installation, operation, modification, maintenance or replacement of a utility pole in the right-of-way provided a permittee is not subject to the municipal telecommunications license tax.
(2) A right-of-way fee shall be directly related to a permittee’s actual use of the right-of-way and shall be $250 annually for each small wireless facility.
(C) Authority-owned utility pole fees. The rate to collocate a small wireless facility on an authority pole is $50 per year, per utility pole.
(D) Additional compensation. The Department shall not, directly or indirectly, as a requirement of issuing a permit, require an applicant perform a service or provide a good unrelated to the permit, including reserving fiber, conduit or pole space for the city.
