(A) Inspection permitted. The Department may inspect, at any time, a permittee’s collocation of a small wireless facility or installation, modification or replacement of a utility pole or wireless support structure. The Department shall determine during an inspection whether the permittee’s small wireless facility, utility pole or wireless support structure is in accordance with the requirements of the permittee’s applicable small wireless facility permit and other applicable law and applicable codes.
(B) Suspension of activities. During an inspection, if the Department determines that a permittee has violated any material term of the permittee’s small wireless facility permit or this subchapter, the Department may suspend the permittee’s small wireless facility permit. The Department shall provide written notice of any suspension to a permittee within three days of discovering the permittee’s alleged violation of their small wireless facility permit. A suspension under this division (B) is effective until a permittee corrects the alleged violation, at the permittee’s sole expense. A permittee may appeal any suspension issued under this division (B) to the Department.
