The violation of any provision of this subchapter is a violation subject to fines. If the person convicted has been previously convicted of a violation of this subchapter, or of any comparable city ordinance or city code provision in effect prior to the adoption of this subchapter, the dog involved in the subsequent violation shall be immediately confiscated by the city, and thereafter destroyed in a humane and expeditious manner.
