§ 135.46 CURFEW FOR MINORS.
   (A)   (1)   No person under the age of 18 years shall remain idle, wander, stroll or play in any public place either on foot or to cruise about without a set destination in any vehicle in, about or upon anyplace in the Village on Sunday through Thursday between the hours of 10:00 p.m. and 6:00 a.m. the following day, and on Friday and Saturday between the hours of 11:00 p.m. and 6:00 a.m. the following day unless accompanied by a parent, guardian, custodian or other adult person having custody or control of such minor or unless the minor is on an emergency errand or specific business or activity directed or permitted by his parent, guardian or other adult person having the care and custody of the minor or where the presence of such minor is connected with or required by some legitimate employment, trade, profession or occupation.
      (2)   During the month of October (including the night of October 31 to November 1, but exclusive of the night of September 30 - October 1) the hour of 10:00 p.m. and 11:00 p.m. in the first paragraph hereof shall be reduced to 8:00 p.m. for each night of the week. Therefore, the hours shall be 8:00 p.m. and 6:00 a.m. the following day for each night of the week.
   (B)   No parent or guardian of such person younger than 18 years of age shall permit such person to be on or about the streets or alleys of the Village of Brewster, Ohio, in violation of the provisions of division (A) of this section. If a person younger than 18 years of age is found on or about the streets or alleys of said village in violation of provisions of division (A) herein, it shall be prime facie evidence of a violation of this section by a parent or the guardian of such person.
   (C)   For the purpose of this section, all persons shall be subject to this section until such persons reach his or her eighteenth birthday.
