(A) Whenever during any period of 24 hours or less, snow falls in the village to a depth of three inches or more, an emergency is declared to exist, in that such a heavy snowstorm constitutes a serious public hazard impairing transportation, the movement of food and fuel supplies, medical care, fire, health and police protection, and other vital facilities of the village; said emergency shall continue until an announcement by the Mayor of the village, or Superintendent of Public Services, that snow plowing operations have been completed, which announcement shall be made in the manner as outlined in division (B) below.
(B) (1) Whenever such an emergency exists, the Mayor of the village, or the Superintendent of Public Services, shall request the cooperation of newspapers and radio stations; (The Evening Independent and WHBC radio station being main methods of communication with village residents) to announce the emergency and the time that the emergency parking regulations will become effective, which time shall be no sooner than one hour after the first announcement by one radio station, or in a daily newspaper or general public distribution, of the existence of the emergency. However, the owners or operators of motor vehicles shall have full responsibility to determine existing weather conditions and to comply with emergency parking regulations.
(2) During the period of the emergency, the Mayor or Superintendent of Public Services may prohibit the parking of any vehicles upon any or all of the village streets hereinafter designated in this schedule as follows:
(a) At any time the snow parking ban is in effect on the following streets: Wabash Avenue from the north to the south corporation limits; Main Avenue, both sides, from Cleveland Avenue to McKinley Avenue (commonly known as public square);
(b) Upon any north/south street or alley on even-numbered days during the snow parking ban (such as 20, 22, 24 and the like); and
(c) Upon any east/west street or alley on odd-numbered days during the snow parking ban (such as 21, 23, 25 and the like).
(3) During the emergency, it shall be unlawful for any person to park, cause to be parked, permit to be parked, permit to remain parked, to abandon, or to leave unattended any vehicle of any kind or description upon such specified streets; provided, however, that vehicles may be parked for a period not longer than three minutes for actual loading or unloading of passengers, or 30 minutes for actual loading or unloading of property; provided further, that no other ordinance restricting parking as to place or time is violated thereby.
(C) Any motor vehicle parked in violation of this prohibition may be impounded at the cost and expense of the owner thereof; the fees to be charged for the towing and storage shall be assessed against the owner of the vehicle which has been towed and stored.
