§ 54.38 CHARGES.
   (A)   Each user shall pay for the services provided by the village based on his or her use of the treatment works as determined by water meter readings (or other appropriate methods) acceptable to the village.
   (B)   For residential, industrial, institutional and commercial users, monthly user charges will be based on actual water usage. If a residential, commercial, institutional or industrial user has a consumptive use of water, or, in some other manner, uses water which is not discharged into the wastewater collection system, the user charge for that contributor may be based on readings of a wastewater meter(s) or separate water meter(s) installed and maintained at the user’s expense.
   (C)   (1)    Each user shall pay a user charge rate for operation and maintenance including replacement.
      (2)   (a)   It is required that every customer’s water connection be metered, and the components of each village wastewater treatment customer’s account will be based on that metering.

         (b)   A monthly minimum is established for each active account and shall include the service charge and the capital charge. The monthly minimum in 2020 shall be $34.66.
         (c)   The revenue provided by the above service charge will be appropriated to the Sewer Replacement Fund each month. Said funds will be used for maintenance and replacement of sewer utility infrastructure as well as for future debt service, if needed.
         (d)   The revenue provided by the above Service Charge will be appropriated to the Sewer Replacement Fund each month. Said funds will be used for maintenance and replacement of sewer utility infrastructure as well as for future debt service, if needed.
         (e)   The revenue provided by the above Capital Charge will be appropriated to the Sewer Debt Fund each month. Said funds will be used to address any debt in the sewer utility.
      (3)   An automatic increase in sewer fees and charges.
         (a)   Village Council hereby authorizes automatic increases of all sewer charges once per year, every year, beginning on January 1, 2021 and every year thereafter by a fixed percentage. This automatic increase shall apply to the sewer usage fee, the service charge, the capital charge, and the sewer surcharge.
         (b)   The fixed percentage shall be 3.0% unless Council approves an action to adjust this amount prior to the automatic increase date. Every three years a sewer rate study will be performed in a timely manner to provide Village Council with relevant information to allow them to conduct an informed review of the sewer rates and the financial stability of the village sewer operations.
         (c)   The automatic increase shall be effective on January 1st of each year and be reflected on the customers' February bills and be effective throughout that 12-month period.
      (4)   A sewer surcharge shall be levied for those users whose sewage has a greater strength than normal domestic sewage, and shall be collected in addition to the normal user charges listed in division (C)(2) above. The surcharge is based on a formula from standards provided by the Ohio EPA with suspended solids (SS) and biochemical oxygen demand (CBOD) as the measured components. The surcharge for operation, maintenance and replacement shall be increased by 20% beginning with the customer’s January usage and shall be increased by 3.0% for the customer’s January usage every year thereafter as follows:

   (D)   The village shall require a deposit of $750 for tapping the sewer main. The village will perform the tapping of the main and install the piping to the street right-of-way. The cost to the village will be applied against the $750 deposit and the difference returned to the applicant. If the total cost should exceed the $750 deposit the applicant shall pay the difference.
   (E)   The sewer deposit fee shall be $50.
   (F)   Any user which discharges any toxic pollutants (as defined in §§ 54.15 through 54.23) which cause an increase in the cost of managing the effluent of the sludge from the village treatment works, or any user which discharges any substance which singly or by interaction with other substances causes identifiable increases in the cost of operation, maintenance or replacement of the treatment works, shall pay for such increased costs. The charge to each such user shall be as determined by the appropriate financial personnel and approved by the Council.
   (G)   The user charge rates established in this subchapter apply to all users of the village treatment works.
   (H)   Single-family equivalency sewer usage charge.
      (1)   Village Council establishes a single-family equivalency (SFE) sewer usage charge for sewer customers for whom the installation of a water meter is not practical or possible, and that the SFE charge be based on the average usage of all village residential sewer customers at 4,400 gallons per month in 2019 and up to 6,000 gallons per month each year thereafter.
      (2)   Village Council directs that the SFE sewer usage charge be set at up to 6,000 gallons per month. The Village Administrator shall review the sewer usage of all metered residential water customers to establish the average gallons per month residential customer's usage that shall be the SFE sewer usage charge effective on January 1 of each calendar year.
      (3)   The revenue provided by the above SFE sewer usage charge will be appropriated to the Sewer Fund each month.
