§ 37.08 SALE OF SURPLUS PROPERTY ON THE INTERNET.
   (A)   Council declares its intent to sell by internet auction certain surplus property acquired for the use of village departments, including motor vehicles, equipment, tools, or supplies, which are not needed for public use, or are obsolete or unfit for the use for it was acquired.
   (B)   The auction shall be conducted continuously, and from time to time, by the Village Administrator through internet web sites maintained for the purpose of internet auctions. Property put up for auction shall be open for bidding for not less than 15 days, inclusive of Saturdays, Sundays, or legal holidays. The Village Administrator shall determine the items of sale, the minimum bid, the bidding period, and the delivery and payment terms on each item put up for the internet auction. Each item shall be sold “as is” to the highest bidder. The village shall make no warranties or guarantees regarding any item sold.
   (C)   The Village Administrator shall publish in a newspaper of general circulation in the village, notice of intent to sell unneeded, obsolete, or unfit municipal personal property by internet auction. The notice shall include a summary of the information provided in this resolution, and shall be published twice. The second and subsequent notice shall be published not more than ten days nor more than 20 days after the previous notice. A similar notice shall be posted continuously throughout the calendar year in a conspicuous place in Village Hall and on the village web site.
