§ 35.12 AFFIDAVIT FILED IN CASE OF ARREST WITHOUT WARRANT.
   When a peace officer has arrested a person without a warrant, he or she shall, without unnecessary delay, take the person arrested before the court having jurisdiction of the offense, and shall file or cause to be filed an affidavit describing the offense for which the person was arrested. Such affidavit shall be filed with the court or with the prosecuting attorney of said court.
