(A) Streets. The following procedures will be taken upon any request to open a platted street within the village corporation limits.
(1) A petition is submitted to the Village Council to open a platted street. At that time the petitioner will be advised by the Village Administrator that a non-refundable fee of $150 is required to be submitted with the petition to cover processing expenses such as legal ads and legal notices. The petitioner will also be given a copy of these procedures at the time of submitting his or her petition.
(2) At its next regularly scheduled Council meeting, Village Council shall refer the request to the Village Planning Commission for its review and a recommendation. The Village Planning Commission for its review will apply their hearing procedures provided In the Village Zoning Code for all of its deliberations.
3. Before scheduling the Village Planning Commission public hearing to begin review of the petitioner’s street opening request, the petitioner shall submit a refundable $1,000 fee to cover the expense of surveying, deed preparation, recording and legal expenses in the event the petition is approved by Village Council. Any unused portion of this fee will be returned to the petitioner. The petitioner also agrees in writing to pay any excess costs above the deposit.
(4) The Village Planning Commission’s recommendation, if positive in nature, at minimum will provide the scope of the opening, an estimated cost, and shall outline who should be expected to fund the opening project
(5) Upon receiving the Planning Commission’s recommendation Village Council shall make a review similar to the above.
(6) If Village Council decides to proceed with the opening prior to any final approval, it will:
(a) Decide the scope of the street opening;
(b) Instruct the Village Administrator to provide an engineer’s estimate for all costs that may
be incurred based on the decided upon scope;
(c) Decide who shall be responsible for all costs incurred; and
(d) Decide who shall be responsible for construction.
(7) Any street construction will be based on the Village’s Construction and Materials Specifications and Standard Construction Drawing Manual adopted by Ord. 06-2001 and as adopted by reference in § 150.02.
(B) Alleys. The following procedures will be taken upon any request to open a platted alley within the village corporation limits.
(1) A petition is submitted to the Village Council to open a platted alley. At that time the petitioner will be advised by the Village Administrator that a non-refundable fee of $150 is required to be submitted with the petition to cover processing expenses. The petitioner will also be given a copy of these procedures at the time of submitting his or her petition.
(2) At its next regularly scheduled Council meeting, Village Council shall refer the request to the Village Council Street and Alley Committee for its review and a recommendation.
(3) Before the Village Council Street and Alley Committee meeting is scheduled to begin review of the petitioner’s alley opening request, the petitioner shall submit a refundable $1,000 fee to cover the expense of surveying, deed preparation, recording and legal expenses in the event the petition is approved by Village Council. Any unused portion of this fee will be returned to the petitioner. The petitioner also agrees in writing to pay any excess costs above the deposit.
(4) The Village Council Street and Alley Committee recommendation, if positive in nature, at minimum will provide the scope of the opening, an estimated cost and shall outline who should be expected to fund the opening project.
(5) Upon receiving the Village Council Street and Alley Committee recommendation Village Council shall make a review similar to the above.
(6) If Village Council decides to proceed with the opening prior to any final approval it will:
(a) Decide the scope of the alley opening;
(b) Instruct the Village Administrator to provide an engineer’s estimate for all costs that may
be incurred based on the decided upon scope;
(c) Decide who shall be responsible for all costs incurred; and
(d) Decide who shall be responsible for construction.
(7) Any alley construction will be based on the Village’s Construction and Materials Specifications and Standard Construction Drawing Manual adopted by Ordinance 06-2001 and as adopted by reference in § 150.02.
