§ 150.01 ADOPTION OF POLICY AND PROCEDURE FOR ALLEY, STREET AND RIGHT-OF-WAY VACATION.
   (A)   The Policy and Procedures for the Vacation of Alleys, Streets, and Rights-of-way attached to Ord. 58-2017, is hereby adopted as the official policy and procedures to be followed in the cases of property owners requests for the vacation of alleys, streets, and rights-of-way.
   (B)   (1)   For each alley, street and right-of-way vacation petition for which no notice is required in accordance with R.C. § 723.06, a non- refundable fee of $50 shall be collected from the petitioner, to compensate the village for its expenses in processing the petition.
      (2)   For each alley, street and right-of-way vacation petition for which notice is required in accordance with R.C. § 723.07, a non- refundable fee of $1,050 shall be collected from the petitioner, to compensate the village for its expenses in processing the petition.
      (3)   The foregoing non-refundable fees may be modified by Brewster Village Council by motion from time to time to reflect the true cost of processing the vacation petition.
   (C)   The petitioner is responsible for completing and for the expenses of the required drawings, surveying, deed preparation, recording, and legal documentation in the event that the petition is approved by Brewster Village Council and the alley, street, or right-of-way is to be vacated. The petitioner shall complete the foregoing steps and have the vacation recorded with the Stark County Recorder within six months after approval by Village Council, or the vacation shall be null and void.
