§ 32.04 BOARD OF POLICE COMMISSIONERS.
   (A)   There is hereby created a Metropolitan Board of Police Commissioners for the town, which Board shall have full powers and duties as set forth under the laws of the state and as modified from time to time hereafter.

   (B)   (1)   The Board shall consist of three members, who shall be appointed by the Town Council. All members shall be legal residents of the town, and not more than two shall be of the same political party. Each member shall serve a three-year term, with terms staggered such that one Commissioner is appointed on January 1 of each year.
      (2)   The Town Council may appoint members of the Town Council to serve on the Board. The Town Council may appoint up to three Town Council members to serve on the Board, subject to the political party limitations described above. A Town Council member serving on the Board shall vacate his or her position on the Board at any time that the member’s term on the Town Council ends for any reason. Each of such Commissioners shall be subject to removal by the Town Council for any cause which the Town Council may deem sufficient.
      (3)   Before entering upon his or her duties, each member shall take and subscribe an oath of office before the Clerk-Treasurer and shall also take and subscribe before such Clerk-Treasurer the further oath or affirmation that, in any and every appointment or removal to be made by him or her to and from the police force created and to be organized by him or her under the laws of the state, he or she shall in no case and under no pretext appoint or remove any police officer, officer of the police, or other person because of any political affiliation of such person, or for any cause or reason other than that of fitness or unfitness of such person. A Town Council member who is a member of the Board is excused from this provision.
      (4)   A Board member shall give bond in the penal sum of $5,000, payable to the state and conditioned upon the faithful and honest discharge of the member’s duties. The bond must be approved by the Town Council. A Town Council member who is a member of the Board is excused from this provision.
      (5)   The salary of the Board members shall be $400 per year, payable annually out of the Treasury of the town. A member of the Town Council serving on the Board shall receive no salary.
      (6)   The Town Council shall not appoint a police officer employed by the town to serve on the Board.
