Subject to the exception set forth below in this section, it shall be unlawful for any person, firm, partnership or corporation to sell, use or discharge any fireworks within the city including, but not limited to, “safe and sane” fireworks as that term is defined in Cal. Health & Safety Code, Part 2 of Division 11, as the same may be amended from time to time hereafter.
EXCEPTION: Nothing in this chapter shall preclude the presentation of a public display of fireworks including, but not limited to, “safe and sane” fireworks, by the city. The City Council may contract with a person, firm, partnership or corporation to provide such public display upon terms and conditions deemed advisable by the City Council.
