The Director may sell or otherwise dispose of any newsrack, together with its contents, and retain the proceeds, on behalf of the city, from any such or other disposition and any moneys contained in the newsrack at the time of its impoundment, provided that either:
A. Thirty (30) days have elapsed since impoundment occurred, no hearing has been required within, the time permitted, and the owner has failed to pay all impound fees assessed; or
B. A hearing and an appeal, if filed, have resulted in a final determination that the newsrack was properly impounded and fees assessed have not been received within thirty (30) days from the date of said final determination.
