§ 12.08.020 REPAIR AND REPLACEMENT OF CURBS AND SIDEWALKS AFFECTED BY ABANDONED OR DISCONTINUED PRIVATE DRIVEWAYS.
   When the City Council determines either that driveways through curbs and over sidewalks have been abandoned, or that it is for the best interests of the city that their use be discontinued by the adjoining property owner, the city will give fifteen (15) days written notice either to the occupant of the property, or to the owner of the property as shown by the last equalized assessment roll, that the owner of the abutting property shall at the owner's expense, replace such curb and sidewalks under city plans and specifications, and that the owner of the property shall within fifteen (15) days from date of notice elect in writing filed with the City Clerk to either improve the property under city specifications at the owner's expense, and if the owner so elects shall make the improvement within thirty (30) days thereafter, or if the owner does not so elect to improve the property at the owner's expense, the city shall immediately improve the property by having curb and sidewalks repaired or their installation made, and that upon completion of such repair or installation, notice of the costs thereof shall be mailed to the property owner with demand for payment, and the property owner shall have thirty (30) days in which to make payment from the date of mailing of the demand. If payment is not made within that time, the amount thereof shall become a charge and lien upon the property and added to the next year's assessment roll and shall be payable with the following year's taxes against the property.
