§ 10.48.060 STANDING OR SITTING ON, OR OCCUPYING CENTER MEDIANS PROHIBITED.
   A.   No person shall stand or sit upon, or otherwise occupy a center median for any purpose other than to do so temporarily while lawfully crossing any roadway. For purposes of this section “center median” shall mean and refer to that portion of a highway, not less than two (2) feet in width, which is painted or raised, and which separates the roadway for traffic in opposite directions.
   B.   It shall be unlawful for any person to violate any provision, or fail to comply with any of the requirements, of this section. Any person violating any provision of this section or failing to comply with any of its requirements shall be deemed guilty of an infraction and upon conviction thereof shall be punished by a fine not exceeding one hundred ($100) for a first violation; a fine not exceeding two hundred ($200) dollars for a second violation within one (1) year; and a fine not exceeding five hundred ($500) dollars for each additional violation within one (1) year.
   C.   A violation of any of the provisions of this section shall constitute a nuisance and may be abated by the city through civil process by means of restraining order, preliminary or permanent injunction, or in any other manner provided by law for the abatement of such nuisance.
