A. Whenever the citing official determines that there exists a continuing violation of any provision of this code related to building, plumbing, electrical, mechanical or other similar structural or zoning issues, that does not create an immediate danger to health or safety, the citing official shall issue or cause to be issued a written compliance order to any responsible person, and such order shall be served by the citing official as provided in this chapter.
B. When any chapter of this code provides for issuance of a cease and desist order, failure to immediately comply with such order shall be a violation of this code and grounds for issuance of an administrative citation in accordance with § 1.04.290 provided, however, that the violator shall have all rights to a hearing and appeal as are provided in such other chapter. If such violator is determined by a hearing officer to not have been in violation of the cease and desist order following such hearing and/or appeal, the administrative citation shall be dismissed.
