In case of the location of any pole or post in any street, alley, sidewalk or public place without the written consent of the Street and Alley Committee of the Council having first been obtained as hereinbefore provided, or in case of the erection of the same at a point other than the place designated as aforesaid, or in case there should exist a reasonable necessity for the removal or relocation of any pole or post for reasons as in § 153.31 hereof designated, and the person, company or corporation so maintaining any pole or post shall fall or refuse, after reasonable notice, to remove or relocate the same, then and in either of the cases the city, through its officers, agents and employees, shall have the right to remove any poles or posts and the cost of removal or relocation may be recovered by the city from the person, company or corporation so locating and maintaining the same in an action therefore in any court of competent jurisdiction.
