§ 153.12  ROOF, AWNING, SIGN OR STRUCTURES EXTENDING OVER STREET OR SIDEWALK.
   (A)   It is declared unlawful to construct any shed, roof, awning or sign over or across any street, alley or sidewalk in the city in a manner that the outer edge of the same shall rest on posts or pillars placed in any street, sidewalk or alley for the outer support of the same.
   (B)   It is unlawful to construct or adjust any other kind of awning over and across any sidewalk in a manner as that any part of the awning, or the irons or rigging for the support of the same shall be at a less distance than 8 feet above the surface of the sidewalk which the same extends when the awning is lowered.

   (C)   It is declared unlawful to construct or maintain any house, barn, shed, fence or other structure in a manner so that any part of the same, shall extend out over the property line and into and on any street, alley or sidewalk of the city, and when any structure is found so located the owner of the same shall remove the part so extending over the property line from the street, alley or sidewalk, and, if the part is not removed from any street, alley or sidewalk within 20 days of the date of receiving written notice to remove the same, notice to be given by the Street Commissioner to the owner of any house or other structure or to his or her agent, then the Street Commissioner shall remove the part of any building or other structure so extended out, over and into any street, alley or sidewalk doing as little damage to the property as possible and at the least practicable expense and the costs of removal shall be recovered by the city from the owner of the property together with a reasonable attorney's fee for the collection of the same.
   (D)   Provided, that the remedy herein provided shall not exempt the person constructing or maintaining any building or structure from the penalty.
