For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
DIRECT ROUTE. The shortest reasonable path of travel or a commonly used route to reach a final destination without any detour or stop along the way.
EMERGENCY. Any unforseen circumstances or combination of circumstances, or state or condition resulting therefrom that requires or calls for immediate action to safeguard life, limb or property. The term includes, but is not limited to, a fire, natural disaster, an automobile accident or any situation requiring immediate action to prevent or respond to any serious bodily injury or death or serious property damage.
ESTABLISHMENT. Any privately-owned place of business within the corporate limits of the City of Brazil operated for profit to which the public is invited, including, but not limited to, any place of amusement or entertainment (such as movie theater, pool or billiard establishment, concert hall, video machine establishment and the like).
MINOR. Any person under 18 years of age.
OFFICER. A police officer or other law enforcement officer charged with the duty of enforcing and having jurisdiction to enforce the laws of the State of Indiana and the ordinances of the City of Brazil.
OWNER/OPERATOR. Any person or entity operating, managing or conducting business in any establishment, and the employees, agents, officers or representatives thereof (including a sole proprietorship, partnership, association or corporation).
PARENT. A person who is a natural or biological mother or father, adoptive parent, foster parent or stepparent of another person who has custody or control of a minor, or other person to whom legal custody of a minor has been given by court order.
PUBLIC PLACE. A place to which the public or a substantial group of the public has access, including, but not limited to, streets, highways, roads, alleys or parking lots, transportation facilities, theaters, restaurants, shops, bowling alleys, schools and school grounds, museums, playgrounds, places of business and amusement, swimming pools, cemetery, community centers, YMCA, hospitals, office buildings, governmental buildings and property and any other areas that are open to or accessible to the public.
RESTRICTED CURFEW HOURS.
(1) For a minor 15, 16 or 17 years of age: after 11:00 p.m. on any Sunday, Monday, Tuesday, Wednesday or Thursday, and before 5:00 a.m. on Monday, Tuesday, Wednesday, Thursday or Friday, and between 1:00 a.m. and 5:00 a.m. on Saturday and Sunday;
(2) For a minor less than 15 years of age: after 11:00 p.m. or before 5:00 a.m. on any day; and
(3) For a minor in a cemetery or other facility used to memorialize the dead within the corporate limits of the City of Brazil: after 9:00 p.m. and before 5:00 a.m. on any day.
