§ 113.31  ITINERANT OR TRANSIENT PHOTOGRAPHER; FEES.
   (A)   It shall be unlawful for any person to engage in the business or to exercise the vocation of an itinerant or transient photographer in the city without having first procured from the city a license to do so and pay to the city for the license the sums of money hereinafter designated.
   (B)   Any person desiring to procure the license as above provided for shall pay to the Clerk-Treasurer the fee hereinafter provided, for which the Clerk-Treasurer shall execute to the applicant his or her receipt. On presentation of a receipt to the Clerk-Treasurer, the Clerk-Treasurer shall issue to the applicant a license to conduct the business or vocation of an itinerant or transient photographer, as the same is hereinafter defined, within the city for the period of time for which the applicant shall have paid according to the scale hereinafter set out. The license shall be signed by the Clerk-Treasurer. The license shall be issued for the period of 1 day or for any number of days less than 1 week, or for 1 week, or for any number of weeks less than 1 month, or for 1 month or for any number of months less than 1 year, according as the same may be applied and paid for and the charge for the license shall be:
      (1)   For each day-$2;
      (2)   For each week-$10;
      (3)   For each month-$25; and
      (4)   For each year-$100.
   (C)   For the purpose of this section, an ITINERANT PHOTOGRAPHER or TRANSIENT PHOTOGRAPHER shall be any person who goes about from place to place in the city taking photographs or pictures of scenes, objects, buildings, structures, animals or person or groups, assemblages or processions of persons, for hire or pay, or for the purpose of developing the negatives so taken and selling the developed picture or negative, or for the purpose of receiving compensation, or a consideration for a work or picture, in any way.
   (D)   It is declared unlawful for any person so licensed as hereinbefore provided, or for any person not so licensed, engaged as an itinerant or transient photographer or acting as so in the city, to take any flash light picture of any public assemblage or person or persons in any church, theater, hall, building or other enclosure in the city, and any person engaged as a photographer in the city is prohibited from taking any obscene, licentious, indecent or immoral pictures or from taking any snapshot of any person against the wishes of the person or to his or her annoyance, except the snapshot be taken to aid in the detection and prosecution of crime.
