§ 110.04  SERVICE CHARGE FOR UNHONORED OR RETURNED CHECKS.
   (A)   Purpose. The Brazil city water utility’s tariff approved by the Public Service Commission of Indiana on September 5, 1984 provided for the charging of a "bad check charge" by the water utility in the amount of $5 per check to any customer who presents a check on an overdrawn account, on an account with insufficient funds or deposit or on a closed account for payment of metered water charges or other water utility charges provided in that tariff. The purpose of this section is to provide for the charging of a "bad check charge" as set forth in the tariff and established a procedure for the enforcement and collection of a charge.
   (B)   Charge for the presentment of bad checks.
      (1)   The Brazil city waterworks shall charge any customer thereof a "bad check charge" in the sum of $5 per check who presents to the waterworks office any check on an overdrawn account, with insufficient funds on deposit, or on a closed account for payment of that customer’s metered water charge or other water utility charges as provided in that tariff.
      (2)   This section and the "bad check charge" provided for herein shall be administered and collected by the staff of the supervisor of the waterworks office either by placing that charge on the customer’s next water bill, by collecting it at the time the customer resubmits payment of the overdrawn check or by the utilization of any legal means available for the collection of bad checks. The supervisor shall establish a procedure.
