(A) There is hereby created and established a Skate Park Advisory Board under the direction of the Brazil City Park and Recreation Board for the City of Brazil which shall consist of 5 members, citizens and residents of Clay County, Indiana, 4 of whom 2 shall be appointed by the Mayor and 2 shall be appointed by the Brazil City Parks and Recreation Board. The Brazil Human Resources/Safety Director shall be the remaining member of the Skate Park Advisory Board.
(B) The term of the 4 persons shall be 2 years except that the term of 1 of the members appointed by the Mayor and 1 of the members appointed by the Brazil Parks and Recreation Board to the first board shall be for only 1 year and the term of 2 members of the first board shall be for 2 years. In the event that a vacancy shall occur during the term of any member, his or her successor shall be appointed by the respective appointing party for the unexpired portion of the term.
(C) Members of the Board shall serve without compensation.
(D) It shall be the responsibility of the City Skate Park Advisory Board to study, investigate, counsel and develop and/or update, and administer a written plan for the construction, care and maintenance of the Skate Park to be built in George Craig Park. A plan will be presented to the Brazil Parks and Recreation Board and upon their acceptance and approval shall constitute the official comprehensive construction and maintenance plan for the skate park. The plan may be updated periodically and an updated plan will be affective upon approval by the Brazil City Parks and Recreation Board.
(E) The City Skate Park Advisory Board shall serve as an advisory council to the Brazil Parks and Recreation Board concerning the construction, care and maintenance of the skate park. However, authority and control over city parks shall remain with the Brazil Parks and Recreation Board. The City Skate Park Advisory Board shall receive monetary donations from the community and individuals, and deposit all monetary contributions into the Skate Park Fund. Furthermore, the City Skate Park Advisory Board shall have the authority to disburse monies therefrom to construct and maintain for the citizens and youth of Brazil and Clay County, a skate park in George Craig Park.
(F) The City Skate Park Advisory Board shall choose its own officers, make its own rules and regulations, and keep minutes of its proceedings which will form permanent records on file in the City Clerk-Treasurer's office. A majority of the members shall be a quorum for the transaction of business.
(G) The Brazil City Parks and Recreation Board shall have the right to review the conduct, acts and decisions of the City Skate Park Advisory Board. Any person may appeal from any ruling or order of the City Skate Park Advisory Board to the City Parks and Recreation Board who may hear the matter and make final decisions.
