§ 91.03  OFFENSES.
   (A)   Any person who knowingly consumes an alcoholic beverage or possesses a container that has been opened, that has a broken seal or from which some of the contents have been removed, while in a motor vehicle that is being operated on a public street within the city commits a violation of this chapter with the following exception: a person may possess a container that has been opened, that has a broken seal or from which some of the contents have been removed, if the container is possessed solely for the purpose of transporting the same or storage, are not consumed in the motor vehicle, are not present in the immediate area, and are otherwise allowed to be possessed under state law.
   (B)   The operator or owner of a motor vehicle who, while the motor vehicle is in operation, knowingly keeps or allows to be kept in the immediate area of the motor vehicle a container that has been opened, that has a broken seal, or from which some of the contents have been removed, commits a violation of this chapter.
