(A) The following individuals shall be exempt from this chapter:
(1) A passenger of a vehicle in which the driver is operating the vehicle pursuant to a contract to provide transportation for passengers and the driver holds a valid chauffeur's license pursuant to I.C. 9-24-1-2;
(2) A passenger of a bus in which the driver holds a valid chauffeur's license pursuant to I.C. 9-24-1-2; and
(3) A passenger in a recreational vehicle.
(B) The exemption in division (A)(3) above shall not apply to any passenger located in the immediate area.
