(A) Advisory Board of Zoning Appeals. The Board of Zoning Appeals shall operate pursuant to I.C. 36-7-4-901 et seq., and shall be known as the Advisory Board of Zoning Appeals.

(B) Five-member Board. The Advisory Board of Zoning Appeals shall consist of 5 members and appointment of members shall be as follows:
(1) Three citizen members shall be appointed by the executive of the municipality (the Mayor), of whom 1 shall be a member of the City Plan Commission and 2 shall not be members of the City Plan Commission. One member shall be appointed by the municipal legislative body (Common Council of the City of Brazil, Indiana), who must not be a member of the City Plan Commission. One citizen member shall be appointed by the City Plan Commission, who must be a member of the City Plan Commission other than the member appointed under division (B)(2) below; and
(2) Each appointment shall be for a term of 4 years. A member shall serve until his or her successor is appointed and a member is eligible for reappointment.
