§ 30.018  CITY PLAN COMMISSION.
   (A)   Seven-member City Plan Commission. The City Plan Commission shall consist of 7 members and shall be appointed as follows.
      (1)   The municipal legislative body (The Common Council of the City of Brazil, Indiana) shall appoint 3 persons, who must be elected or appointed municipal officials or employees in the municipal government, as members.
      (2)   The municipal executive (the Mayor) shall appoint 4 citizen members, of whom no more than 2 may be of the same political party.
      (3)   Upon the establishment of a 7-member City Plan Commission, 2 citizen members shall initially be appointed for a term of 3 years and 2 shall be appointed for a term of 4 years. Each member's term expires on the first Monday of January of the second, third or fourth year, respectively, after the year of the member's appointment. Appointments by the municipal legislative body are for 1 year. All members are eligible for reappointment.

   (B)   Powers and duties. The members of the City Plan Commission shall have all powers and duties as prescribed by I.C. 36-7-4-100 et seq.

   (C)   Commission's role to the Common Council. The City Plan Commission shall act in an advisory capacity and shall make recommendations to the Common Council on all zoning ordinances prior to the Common Council taking final action on the zoning ordinance.
