§ 90.22  MONTHLY TRASH COLLECTION PROCEDURE; FEE.
   (A)   Effective February 1, 2007 (utility bills due February 10, 2007), every person who either owns or rents residential property, multi-family dwelling units or mobile homes within the corporate limits of the city, whose property lies outside the corporate limits and along North Murphy Avenue to Hendrix Street, Hendrix Street, Hendrix Street to Murphy Avenue, all property in Deer Creek Subdivision, or any other property located in the corporate limits of the city with the approval of the Board of Public Works and Safety shall be charged a monthly trash collection fee in the amount of $10.50 per household to be added as a separate charge on his or her monthly water bill and payable at the City Waterworks office.

   (B)   Excluded from this fee are business and commercial concerns, and governmental entities.
   (C)   (1)   If a residential owner or occupant does not pay the monthly trash collection fee within 60 days after it becomes due, the city shall discontinue the collection service to that residential unit, and it will be the obligation of the owner or occupant to either make other arrangements for trash collection and removal or pay the past due fees plus a continuation of service charge of $10 for resumption of city service to that residence.
      (2)   Failure to pay the collection fee for a period of 18 months after it becomes due shall result in the city attaching a lien on the applicable real estate as an additional assessment to the property taxes applicable thereto.

   (D)   No person shall place, put or deposit any trash, garbage, waste or rank elements, either placed in any type of container or bag, or any empty trash container or bag in any tree row, street or on that person’s property or residence in a manner so that it is visible from a public street, except for the designated collection day each week or the designated heavy trash collection day and no earlier than the day before any designated collection day.  Furthermore, all containers or empty trash containers shall be removed from the tree rows, sidewalks, street or on that person’s property or residence in a manner so that it is visible from a public street by the end of the person’s normally or re-scheduled trash collection day if the trash collection day falls during the week of a city authorized and approved holiday.
