§ 53.045  INSPECTION; APPROVAL OF THE FIRE CHIEF; GUARANTEES.
   (A)   All fire service shall be subject to inspection by the Waterworks from time to time, and the consumer shall give the inspectors all reasonable facilities for making the inspections and any information concerning the same that the inspector or the Waterworks may require. Care will always be taken that inspections will be made with as little inconvenience to the consumer or occupant as possible.

   (B)   All applications for private fire protection shall be subject to the written approval of the Chief of the Fire Department, who, in the approval, shall state that in his or her opinion the public fire protection will not be endangered by the connection proposed to be made by the Waterworks when properly safeguarded by the placing of an indicator post valve as near the main as possible, the valve to be under the control and orders of the Chief of the Fire Department, at time of fires, with full authority to close the valve.

   (B)   (1)   The Waterworks in no manner guarantees to furnish a proper quantity of water through the fire protection service nor does it undertake to guarantee anything relative to the services, but it will endeavor to maintain the efficiency of its service under all conditions.
      (2)   The granting of a permit for private fire protection is under the express condition that the Waterworks shall not be considered or deemed in any manner to have undertaken to extinguish fire or to protect any person or property against loss or damage by fire or otherwise; the Waterworks is not an insurer of persons or property and it shall be free and exempt from any and all claims for damage on account of any injury to persons or property by reason of fire, water, failure to supply water or pressure, or for any other cause whatsoever, and, in the event of the destruction of the premises of the consumer, the contract between the Waterworks and the consumer shall immediately cease.
