(a) No person shall, by filling or any other means, change the grade of any portion of a lot or parcel of land within the Village without having first obtained a permit therefor issued by the Building Inspector in accordance with the provisions of this chapter.
(b) The Building Inspector shall issue a permit for grading and/or filling if all of the provisions of Chapter 1331 have been complied with and if the following conditions have been met by the applicant:
(1) Applicant shall furnish the Building Inspector along with his application for a permit, four copies of a topographical survey of the entire lot or parcel of land which is intended to be graded or filled, either in total or part thereof, depicting existing conditions and the contemplated grading or filling work. The format and required information for such survey and grading plan shall conform to the prototype entitled "Sample Topographical Survey and Grading Plan (Pre-Construction and As-Built)" which is on file in the office of the Building Inspector and the Village Engineer. No permit to grade and/or fill shall be issued by the Building Inspector without prior approval of such Topographical Survey and Grading Plan (Pre-Construction) by the Village Engineer. The site shall then be graded in conformance with the approved plan;
(2) In the case of Lake Erie shoreline remediation, applicant shall demonstrate that the necessary U.S. Army Corps of Engineers permit has been acquired or, if no such permit is required, then evidence from the Corps confirming same shall be furnished to the Building Inspector;
(3) For all sites greater than five acres, applicant shall show evidence that he has filed a Notice of Intent (NOI) and appropriate application for a National Pollution Discharge Elimination System Permit (NPDES) from the Ohio Environmental Protection Agency (OEPA);
(4) Access and ingress to the site have been approved by the Village Engineer;
(5) Bond pursuant to Section 1331.03 of this chapter has been posted;
(6) Loads will be tarped as required by the Building Inspector;
(7) Appropriate dust control measures will be taken as required by the Building Inspector;
(8) Dumping and filling will be carried out only during normal business hours, pursuant to a schedule as determined by the Village, excluding Saturdays, Sundays and holidays except in an emergency as approved by the Mayor; and
(9) Weight limits per load are disclosed to Building Inspector and approved by him.
(c) No separate permit will be required pursuant to this section is the change of contour or grade is shown and approved as part of an application for a building permit.
(d) The charge for the permit required hereby shall be two hundred dollars ($200.00) and the initial permit shall be valid for no longer than sixty days, unless renewed for an additional sixty days and having a renewal fee of one hundred dollars ($100.00).
