1301.03 BOARD OF BUILDING CODE APPEALS ESTABLISHED.
   (a)   The Board of Building Code Appeals is hereby established. The Board shall consist of the Mayor, who shall act as chairman, the president pro-tem of Council, and a resident freeholder of the Village appointed annually by Council. Minutes of all proceedings and meetings shall be made and preserved, and such freeholder shall act as secretary. All meetings of the Board of Building Code Appeals shall be public. Public notice shall be given of hearings on any appeals from the decisions of the Building Commissioner by the posting of a notice on the bulletin board in the main entrance of the Village Hall for a period of at least three days, together with such additional notice, if any, that the Board of Building Code Appeals shall deem necessary. The Board of Building Code Appeals shall adopt from time to time such rules and regulations as it may deem necessary to carry into effect the provisions of this section. (Ord. 3816.    (b)   Any decision of the Building Commissioner made in the enforcement of this Building Code may be appealed to the Board of Building Code Appeals by any person adversely affected by such decision. Such an appeal shall be made in writing within thirty days after the decision is rendered. (Ord. 3931. Passed 8-16-17.)
   (c)   The Board of Building Code Appeals shall determine all matters promptly presented to it and, where practical difficulties and unnecessary hardships result from the strict compliance with or the enforcement of the provisions of the Residential Code of Ohio for One-, Two-, and Three-Family Dwellings and Part Thirteen - Building Code of the Codified Ordinances, the Board of Building Code Appeals shall have the power to grant variances in harmony with the general intent of such provisions and to secure substantial justice in the promotion of the public health, comfort, convenience, morals, safety and general welfare of the Village.
   (d)   Council shall have the power to approve, amend, modify or reverse any decision of the Board of Building Code Appeals if Council finds that the decision of the Board is not in accord with or is contrary to the purpose and intent of the provisions of this chapter.
