Whoever, being the owner or agent of the owner of any unplatted lot or parcel of land within the Village, willfully divides and transfers a portion of any such lot, parcel or tract of land by metes and bounds description without the prior approval of the Planning Commission as provided in Chapter 1133, shall forfeit and pay the sum of not less than ten dollars ($10.00) nor more than five hundred dollars ($500.00) for each lot, parcel or tract of land so transferred, as determined by Council. Such sum shall be recovered, with costs, in an action brought by the Solicitor in the name of the Village and for the use of the Street Repair Fund.
