331.32 REMOVING FENCE, ENTERING AND EXITING CONTROLLED-ACCESS HIGHWAY.
   (a)   No person shall cut, injure, remove or destroy any fence or other barrier designed and erected to prevent traffic from entering or leaving a limited or controlled-access highway without the permission of the Director of Transportation, except in case of emergency where life or property is in danger. No person shall cause a vehicle of any character to enter or leave a limited or controlled-access highway at any point other than intersections designated by the Director of Transportation for such purpose, except in case of emergency where life or property is in danger.

   (b)   Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
