311.02 PARADES AND ASSEMBLAGES.
   (a)    Permit Required. No person, group of persons or organization shall conduct or participate in any parade, procession or assemblage upon any street or highway, or block off any street or highway area, without first obtaining a permit from the Mayor.
 
   (b)    Application Information. Any person may apply to the Mayor for permission to hold a parade. Such application shall be in writing, in duplicate; shall be submitted to the Mayor not less than five days before the proposed time of such parade; shall state:
      (1)    The correct name and residence address of the applicant and of all other persons who will have complete or partial charge of such parade;
      (2)    The proposed time and route;
      (3)    The approximate number of participants and how many will be on foot, mounted or in vehicles;
      (4)    The name of the organization, if any, represented in such parade;
      (5)    The purpose of the parade; and
      (6)    A complete copy of any legend proposed to be displayed on any sign, banner or otherwise in connection with such parade.
 
   (c)    Permit Fee. A fee of two dollars ($2.00) shall be paid to the Mayor at the time of submitting the application, which fee shall be paid into the General Fund.
 
   (d)    Permit Refusal or Issuance. The Mayor shall consider the application and pass upon the same within twenty-four hours of its submission. The permit may be refused or canceled if:
      (1)   The time, place, size or conduct of the parade including the assembly areas and route of march would unreasonably interfere with the public convenience and safe use of the streets and highways.
      (2)    The parade would require the diversion of so great a number of police officers to properly police the line of movement, assembly area and areas contiguous thereto so as to deny normal police protection to the Municipality.
      (3)    The parade route of march or assembly areas would unreasonably interfere with the movement of police vehicles, fire-fighting equipment or ambulance service to other areas of the Municipality.
      (4)    The parade would unreasonably interfere with another parade for which a permit has been issued.
      (5)    The information contained in the application is found to be false or nonexistent in any material detail.
      (6)    An emergency such as a fire or storm would prevent the proper conduct of the parade.
   The permit or any order accompanying it may limit or prescribe reasonable conditions, including the hours, the places of assembly and of dispersal, the route of march or travel and the streets, highways or portions thereof which may be used or occupied.
 
   (e)    Prohibited Conduct. When a permit has been issued, no person shall take part in the management or direction of the parade held thereunder unless he is named in the application, or participate in the parade at any other time or on any other route than those named in the application, or participate in the parade if it contains a number of participants, vehicles or animals more than fifty percent greater than that stated in the application, or display by sign, banner or otherwise any legend not completely set forth in the application.
 
   (f)    False Information. No person shall knowingly give any false or misleading information in any application for a parade permit.
 
   (g)    Driving Through Parade. No person shall drive a vehicle through a parade except with permission of a police officer.
 
   (h)   Penalty. Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
