121.10 VOTING.
   (a)   Voting requirements:
 
(1)   Motions or regular adoption of legislation   =
four (4) members.
(2)   Emergency adoption of legislation      =
four (4) members.
(3)   Suspension of three readings of legislation   =
five (5) members.
 
   (b)   All members shall cast a vote on a measure unless forced to abstain due to a conflict of interest. If a member of Council abstains due to a conflict of interest, is silent or fails to response to a roll call, such abstention, silence or such failure to respond shall be considered acquiescence to meet the statutory requirement of concurrence of a majority of all members elected to the Council and shall be counted as a vote with the majority. An abstention being used by a member of Council a avoid a yea/nay vote shall be counted as a vote with the majority. An abstention may be questioned as to the nature of the conflict of interest by the President of Council or a Member of Council.
