§ 92.09 BITING ANIMALS TO BE QUARANTINED.
   (A)   General. Whenever an animal has bitten a person, or whenever a known or suspected rabid animal is picked up by the animal control officer, or local law enforcement, the animal shall be confined for a minimum of ten days as follows:
      (1)   If no proof of a current rabies vaccination is provided, the animal shall be quarantined by the animal control officer; and
      (2)   A quarantined animal shall not be removed from quarantine without the written permission of the local law enforcement.
   (B)   Vicious animals.
      (1)   Whenever the City Administrator or local law enforcement determines that any animal, whether wearing a tag or not, has bitten any person, the animal may be deemed to be vicious for the purpose of this section. The animal may be impounded by the animal control officer, or as otherwise designated by the local law enforcement, for a period of ten days or more at the expense of the owner of the animal.
      (2)   The animal shall not be released from the impound until authorized by the local law enforcement. Except for the time limits, disposition and redemption shall be in accordance with § 92.07(I). Failure to maintain quarantine at the specified location in accordance with this section shall be unlawful.
      (3)   Any animal which habitually attacks or threatens people or animals elsewhere than on the premises of the owner, keeper, or harborer, or which is afflicted with hydrophobia, shall be destroyed in a summarily manner and buried by the animal control officer without, however, relieving the owner from liability for due violation of this chapter.
      (4)   Whenever the animal control officer or local law enforcement has reasonable cause to believe that a particular animal presents a clear and immediate danger to residents of the city because it is either infected with rabies, or because of a clearly demonstrated vicious nature, the officer, after making reasonable attempts to impound the animal, may summarily destroy the animal.
