SCHEDULE I. MAXIMUM WEIGHT LIMIT ON STREETS.
   (A)   All motor vehicles, tractor trailers, or any machine or instrument that is driven, pulled, pushed, parked, or driven by a motor vehicle having axle weights in excess of seven tons are prohibited on the public streets and thoroughfares in the city, except those portions of Minnesota Highway Number 107 located within the city limits or unless upon receiving a special permit authorized by the city as described below.
   (B)   The weight restrictions in division (A) above shall not apply to city or emergency vehicles, delivery vehicles, public transportation vehicles, or to vehicles utilized in the pick up and collection of solid wastes.
   (C)   Any police officer having probable cause to believe that the total weight of a vehicle and load is unlawful is authorized to require the operator of the vehicle to stop and submit the vehicle to a weighing at the nearest available scale.
   (D)   The City Administrator, or designees, may, upon application, issue a permit for use of the streets upon the condition that the applicant assumes all responsibility for damage caused to the designated routes by the excess load, and agrees to reimburse the city for all reasonable and necessary expenditures to repair and replace the street to its former condition. A permit fee in an amount as set by Council from time to time shall be charged per vehicle load, or the other fee as set from time to time by resolution of the City Council.
   (E)   Applications for permits shall be on forms which include:
      (1)   A confession of judgment subscribed to by the applicant which, in effect, is a confession of judgment by the permittee with respects to all damages caused to public thoroughfares resulting from hauling activities; and
      (2)   Permit applications shall also specifically designate the routes which vehicles involved in the hauling activities may use.
